Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Popup Moments Inc., a Delaware corporation (“Kangaroo”, “we”, “us”, or “our”), and govern your use of Kangaroo on kangaroo.chat and through the Kangaroo app inside ChatGPT (together, the “Service”).

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Not medical advice

Kangaroo is an educational and organizational companion for pregnancy. It is not a medical provider, not a medical device, and not a substitute for professional care. It does not diagnose, treat, or give medical advice, and it cannot tell you whether a symptom or a value is safe or an emergency. Always talk to your healthcare provider about your care and any decisions. If something could be an emergency, call 911 or your local emergency number, or contact your provider right away. Never delay seeking care, and never disregard professional advice, because of anything Kangaroo says.

Who can use Kangaroo

You must be at least 13 years old to use Kangaroo. If you are under 18, we encourage you to review these Terms with, and to use Kangaroo with the involvement of, a parent or guardian. By using the Service, you confirm that you meet this requirement and that the information you provide is accurate.

The service

Kangaroo helps you follow your pregnancy week by week. You can see where you are, keep a prenatal calendar, add appointments, log symptoms, mood, weight, and blood pressure, ask general questions, and turn on weekly notes and appointment reminders by email. Kangaroo acts on the information and settings you give it.

The Service is provided free of charge. We may change, suspend, or discontinue any part of the Service at any time, and we may set or change limits on use of the Service. We will try to give reasonable notice of material changes where we can.

Health information and safety

Kangaroo does not assess your health. It will not tell you that a symptom or a value is safe, and it does not provide triage or diagnosis. If something you write looks like it could be urgent, Kangaroo may suggest that you contact your provider or seek care and may show crisis resources, but that is general information, not a medical judgment about your situation. You are responsible for deciding when to seek care, and any guidance Kangaroo shares does not replace your provider.

Reminders and email delivery

When you turn them on, Kangaroo sends weekly notes and appointment reminders by email to the address associated with your account, and delivery depends on systems we do not fully control, including your email provider, spam filters, and network conditions. We work to deliver every message on time, but we do not guarantee that a note or reminder will be delivered, or delivered at the exact time or at all. You should not rely on Kangaroo as your only reminder for anything important, such as prenatal appointments, tests, or medication.

Emails we send

By using Kangaroo, you agree that we may send you the weekly notes and appointment reminders you turn on, essential emails about your account, security, or the Service, and occasional emails about new features or improvements. You can turn off weekly notes and appointment reminders at any time, and you can opt out of the product update emails at any time, but you cannot opt out of essential account emails while you have an account, because they are part of operating the Service. We describe this further in our Privacy Policy.

Your account

You are responsible for activity that happens under your account and for keeping your access to it secure. Kangaroo is tied to the account you sign in with, and your email is delivered to the address on that account. Let us know promptly at hi@sponja.ai if you believe your account has been accessed without your permission.

Your content

You own the information and other content you share with Kangaroo (“Your Content”), including your logs, appointments, and notes. We do not claim ownership of it.

You grant us a limited, non-exclusive, royalty-free license to store, process, and send Your Content by email to you solely to operate and provide the Service, as described in our Privacy Policy. This license ends when you delete Your Content or your account, except for residual copies that may remain in encrypted backups for a short period before they are overwritten.

You are responsible for Your Content and confirm that you have the right to share it and that it does not violate these Terms or any law.

AI-generated content

Kangaroo uses AI to interpret what you tell it and to compose your week guidance and answers, including working out dates, weeks, and schedules. This interpretation may be inaccurate or incomplete, and it is general information, not medical advice. You are responsible for reviewing what Kangaroo shows you and confirming it is correct, and you should not rely on Kangaroo as your only copy of important information or as a source of medical guidance. When in doubt, talk to your provider.

Privacy

Our collection and use of your information is described in our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our practices, including how we handle sensitive health information.

Data deletion

You can delete any log or appointment at any time from within Kangaroo, and you can tell Kangaroo to turn off outreach or to pause. To delete your entire account and all of your information, email hi@sponja.ai, or disconnect Kangaroo from ChatGPT’s settings (Apps and Connectors) to immediately stop new data flowing to us. When you ask us to delete your data, we delete it within 30 days, except where we are required to retain certain records to comply with law. Residual copies may persist in encrypted backups for a short period before they are overwritten.

Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, that notes or reminders will be delivered or delivered on time, or that any content, including AI-generated content, will be accurate, complete, or reliable. Kangaroo does not provide medical advice and is not a substitute for professional care. You use the Service at your own risk, and you are responsible for your own health decisions and for seeking care when you need it.

Limitation of liability

To the maximum extent permitted by law, Kangaroo and Popup Moments Inc., and our officers, employees, and service providers, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business, for any missed, late, or undelivered note or reminder, or for any decision made or action taken in reliance on the Service, arising out of or relating to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages. This applies regardless of the legal theory on which the claim is based. Some jurisdictions do not allow certain of these limitations, so some of them may not apply to you.

Indemnification

You agree to indemnify and hold harmless Kangaroo and Popup Moments Inc. from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or any law or third-party rights.

Termination

You may stop using the Service and delete your data at any time, as described above. We may suspend or terminate your access to the Service if you violate these Terms, if we are required to by law, or if we discontinue the Service. For violations that are not serious, we will try to give you reasonable notice where practical. Sections of these Terms that by their nature should survive termination (including the sections on Not Medical Advice, Your Content license residuals, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, unless applicable law gives you the right to bring the dispute elsewhere.
